A United States judge has officially struck down a policy implemented by the administration of President Donald Trump that suspended immigrant visa issuances for applicants spanning 75 countries, ruling that the directive exceeded the statutory authority of Secretary of State Marco Rubio.
Judge Jeannette Vargas delivered her ruling on Friday within the Southern District of New York in Manhattan, declaring the policy "patently unlawful" and in direct conflict with federal immigration law. She noted that the law explicitly strips the secretary of state of authority over the adjudication of immigrant visas by consular officers.
"The Policy, which categorically prohibits the issuance of immigrant visas based upon the nationality of the applicant, represents a direct abrogation of this statutory scheme," Judge Vargas wrote.
Judge Vargas, appointed by former Democratic President Joe Biden, issued the decision following a lawsuit brought forward by immigrant rights groups Catholic Legal Immigration Network and African Communities Together, alongside individual visa applicants and US citizens who are sponsoring family members from the impacted nations.
The suspension, enacted in January of this year, impacted applicants originating from Latin American nations such as Brazil, Colombia, and Uruguay; Balkan countries including Bosnia and Albania; South Asian states like Pakistan and Bangladesh; as well as numerous countries across Africa, the Middle East, and the Caribbean.
The Department of State previously defended the measure by stating that applicants from these targeted countries presented "a high risk for becoming a public charge and recourse to local, state and federal government resources in the United States."
President Donald Trump has maintained an aggressive stance on immigration enforcement throughout his presidency, asserting that such measures are necessary to bolster domestic security. Data from the Center for Constitutional Rights indicates this freeze was introduced alongside other rapid restrictions, following a travel ban encompassing 39 countries on January 1 and a suspension of diversity visas in late December.
Advocacy groups have argued that these immigration crackdowns infringe upon due process and free speech protections, raising alarms regarding potential racial profiling against minorities. The State Department has not yet issued a response to the court ruling.
