A divided United States Supreme Court has granted the White House permission to continue construction on a $400m ballroom project while ongoing lawsuits proceed, marking a significant legal victory for President Donald Trump as he exercises executive power in Washington, DC.

The 5-4 ruling replaces a temporary order that had permitted construction earlier in the month, narrowly avoiding a court-ordered halt. US Chief Justice John Roberts, who handles appeals from the capital, publicly dissented from the decision, calling the project 'likely unlawful' because it lacks congressional approval and arguing it fails to uphold the separation of powers. The court's three liberal-leaning justices joined his dissent.

While the majority did not rule on the project's ultimate legality, it determined that a preservation group likely lacked the legal standing to challenge it. The unsigned opinion also highlighted national security concerns raised by the government. Although the lawsuit will return to lower courts, court documents indicate that key phases of the construction could finish within months.

The legal challenge, brought by the National Trust for Historic Preservation, argued that President Donald Trump lacked unilateral authority to initiate the project, which involved the demolition of the East Wing. Conversely, government lawyers maintained that the president holds total authority over federal building renovations and cited national security requirements for the integrated military complex and secure ballroom space.

Crews are currently working around the clock on the 8,400 square metre project. While a federal judge had previously ordered a halt to aboveground construction, the Trump administration successfully argued for the continuation of the work as legal proceedings continue.
