The current and former presidents of the International Criminal Court’s (ICC) governing body have issued a strong warning that ongoing efforts to diplomatically isolate the institution are designed to undermine confidence in the international legal order. This comes as US President Donald Trump’s administration exerts heavy pressure on countries to distance themselves from the court.

In a joint op-ed published on Thursday on the Just Security law and policy journal’s website, Paivi Kaukoranta, the current president of the ICC’s Assembly of States Parties, alongside seven former presidents, argued that the ICC embodies a collective commitment by sovereign states to prosecute war crimes, crimes against humanity, genocide, and the crime of aggression. They emphasized that the court operates strictly as a court of last resort rather than a replacement for national justice systems.

Addressing criticisms regarding state sovereignty, the authors rejected claims that the court undermines sovereign nations, stating instead that countries exercise their sovereignty by choosing to join international treaties and institutions. The statement arrives amid severe friction with Washington, where the Trump administration has sanctioned ICC judges and officials, and strongly opposed cases involving Israeli Prime Minister Benjamin Netanyahu, as well as past investigations involving US personnel.

Framing the conflict around broader global stakes, the assembly presidents warned against a future where political power dictates the enforcement of international law. They urged the ICC’s 125 member states, regional organizations, and international allies to offer robust political, legal, and practical support to help governments withstand US pressure.

In addition to measures against the ICC, Washington has sanctioned Francesca Albanese, the UN special rapporteur on the occupied Palestinian territory, following statements by Secretary of State Marco Rubio regarding efforts to prompt ICC action against Israeli officials. The Trump administration has also withdrawn from the UN Human Rights Council, UNESCO, the World Health Organization, and halted funding to UNRWA, alongside a broader withdrawal from numerous UN bodies ordered in January by Donald Trump.
