Brazil’s Supreme Court is facing a major internal crisis as the institution weighs investigations into two justices involved in a bitter public dispute. The controversy centers on Justice Alexandre de Moraes, who oversaw the landmark case convicting former President Jair Bolsonaro, and Justice Andre Mendonca, a Bolsonaro appointee.
Justice Mendonca recently released a report detailing alleged connections between Justice de Moraes and disgraced banker Daniel Vorcaro, who is implicated in a massive fraud scheme. In response, Justice de Moraes accused Justice Mendonca of abusing his authority by unsealing the documents. Chief Justice Edson Fachin announced that he would give Brazil’s attorney general five days to review the allegations against Justice Mendonca, while the court prepares to decide whether to launch a formal probe into Justice de Moraes.
Felipe Recondo, a journalist and long-time observer of the court, described the situation as potentially the most dramatic moment in the history of Brazil’s Supreme Federal Court. The unfolding scandal has provided political ammunition for the right, which is using the allegations to challenge the legitimacy of the 27-year prison sentence handed down to former President Jair Bolsonaro for his role in a coup plot.
Following his defeat to current President Luiz Inacio Lula da Silva in 2022, prosecutors stated that former President Jair Bolsonaro and his allies attempted to subvert election results and disrupt the transition of power. These tensions culminated in the January 8, 2023, attack on key government buildings in Brasilia by supporters hoping to trigger a military uprising. Although federal police recommended charges against former President Jair Bolsonaro and several allies in November 2024, the former president has dismissed the case as a politically motivated "witch hunt," drawing backing from figures such as United States President Donald Trump.
Justice de Moraes has become a primary target for Brazil’s far-right due to his handling of high-profile cases, including his oversight of the trial involving former President Jair Bolsonaro and his suspensions of digital platforms like Rumble and X, the latter managed by Elon Musk. The controversy deepened when US Treasury briefly sanctioned Justice de Moraes over his legal actions.
The Vorcaro fraud allegations threaten to severely damage the judiciary's reputation. Unsealed documents indicate that banker Daniel Vorcaro may have sought advice from Justice de Moraes, prompting politicians to demand transparency and, in some cases, the resignation of Justice de Moraes.
As the country approaches the presidential election on October 4, where left-wing President Luiz Inacio Lula da Silva will face Senator Flavio Bolsonaro, both sides are leveraging the scandal to accuse opponents of corruption. Senator Flavio Bolsonaro has sought to frame the controversy as a conspiracy involving Justice de Moraes and the political left. However, the younger Bolsonaro has also faced scrutiny over alleged communications published by The Intercept Brasil, which reportedly showed him soliciting funding from banker Daniel Vorcaro for a film project about his father, former President Jair Bolsonaro. Senator Flavio Bolsonaro has denied any wrongdoing regarding the private project.
