A US federal judge has ruled that the use of the words "terrorism" and "terrorist" will be strictly limited during the upcoming trial of Abu Agila Mohammad Masud. Mr Masud is accused of manufacturing the bomb that destroyed Pan Am flight 103 over Lockerbie, Scotland, in 1988.
US District Judge Dabney Friedrich granted the restriction following a request from Mr Masud's court-appointed defence team during a pre-trial hearing on Monday. Ms Friedrich explained that the measure is necessary to prevent jury bias, though the terms will still be permitted in specific contexts, such as witness job titles and areas of expertise.
The 1988 bombing resulted in the deaths of all 259 people on board, along with 11 individuals killed on the ground in Lockerbie by falling debris. The tragedy occurred shortly after the Pan Am flight departed from London on December 21, 1988, with 190 US citizens among the 270 total victims. Previously, former Libyan intelligence officer Abdelbaset Al Megrahi was convicted of the bombing and died in 2012.
Mr Masud attended Monday's pre-trial hearing, listening through headphones with the assistance of a translator. First charged in 2020 and transferred to US custody in 2022, his trial has faced repeated delays due to health complications, defence team challenges, and extensive pre-trial proceedings.
During the hearing, US prosecutors stated their intention to present up to 150 pieces of crash evidence that have been stored in Scottish warehouses for decades. Additionally, Ms Friedrich indicated she would permit certain phone and video communications between Mr Masud and his family during his time in US custody to be introduced at trial.
Both prosecution and defence teams have also submitted proposed jury instructions, which notably feature warnings cautioning potential jurors against consulting online prediction and betting markets like Kalshi or Polymarket. Jury selection for the Lockerbie trial is tentatively scheduled to begin on August 25.
In other recent rulings, Ms Friedrich determined that the majority of a purported confession made by Mr Masud to a Libyan investigator in 2012 can be presented at trial. The defence had previously contested the confession, arguing it was obtained under duress involving threats and assault. Legal arguments have also addressed historical documents, including a Telex message from Pan Am concerning baggage handling procedures. Investigators have long maintained that the bomb was concealed in a suitcase in Malta before being transferred to Flight 103 at London's Heathrow Airport.
The upcoming legal proceedings coincide with renewed public interest driven by the recent release of a six-part Netflix mini-series, The Bombing of Pan Am Flight 103, which has climbed into the streaming platform's top 10 US television shows. A follow-up pre-trial hearing is scheduled for Wednesday.
