Award-winning Kashmiri filmmaker Arfat Sheikh has been released from custody by the Immigration and Customs Enforcement (ICE) agency in the United States after being detained on September 24. According to a statement released by a campaign organized by his friends and relatives, his release occurred on Thursday, just two days after he was granted bond.

Despite his release, the deportation case against Sheikh remains active, with his next hearing officially scheduled for October 27. Sheikh was initially detained by the Department of Homeland Security (DHS) at Dulles International Airport outside Washington, DC, as he stepped off a plane arriving from California.

The 42-year-old resident of Alexandria, Virginia, originally entered the US in 2019 on a student visa to pursue graduate studies in film at Georgia State University, later filing for asylum in 2020. His supporters stated that his asylum application was pending and that he held legal authorization to live and work in the country.

Conversely, the DHS asserted that Sheikh legally entered the US temporarily but subsequently overstayed his lawful admittance. The agency maintained that a pending application does not confer legal status, though he would still receive due process.

Sheikh is recognized for his critically acclaimed work exploring conflict in India-administered Kashmir. His feature film Saffron Kingdom earned multiple accolades, including best feature film honors at the Chicago Filmmakers Awards, Los Angeles Film and Documentary Awards, Melbourne Independent Film Festival, Wake Forest Film Festival, and Anatolian International Film Awards. Additionally, he received the emerging filmmaker activist award at the Teaneck International Film Festival in 2025.

His detention coincided with a broader surge in ICE arrests across the US, which reached record-breaking levels during the summer months with approximately 50,000 arrests recorded in July and August. The administration of President Donald Trump previously announced efforts to identify and revoke the non-immigrant visas of individuals entering as short-term visitors who subsequently file for asylum.
