Two former Federal Bureau of Investigation (FBI) agents, Nikki Floris and Bradley Benavides, have been charged with lying to Congress in connection with a 2020 investigation into a laptop belonging to Hunter Biden, son of former President Joe Biden. They made their initial court appearance in Washington, DC, on Friday.
Attorneys for the agents alleged that the Department of Justice (DOJ) filed the charges to reignite the controversial laptop saga shortly before the November 3 midterm elections, a period when Republicans are seeking to maintain control of Congress against Democratic challenges.
A lawyer for Floris stated that she had "served our nation as a dedicated FBI intelligence officer for nearly 20 years" and accused the Justice Department of basing its case on hearsay rather than facts. "It’s no coincidence the government is filing these nonsense charges now, years later, on the eve of an election," the statement read.
Floris and Benavides were in charge of the Foreign Intelligence Task Force (FITF) at the FBI when Hunter Biden's laptop was discovered. Both agents had testified to Congress that the FITF, which focuses on foreign interference in US elections, was not involved in the laptop investigation. However, federal prosecutors claim in a criminal complaint that these statements contradict messages exchanged during that period.
The FITF, initially established by Donald Trump, faced significant scrutiny from Republicans during Joe Biden's presidency, with accusations of political bias and attempts to conceal information about Biden's laptop. The unit was reportedly disbanded when Trump took office for a second term in January 2025.
The existence of the laptop first came to light in October 2020, just weeks before the presidential election between Biden and Trump. Its origins, reportedly involving a Delaware computer repair shop and abandonment by Hunter Biden, raised suspicions. The New York Post first reported on its contents, citing information provided by Trump lawyer Rudy Giuliani. Several former intelligence officials suggested the laptop could be part of a Russian disinformation campaign. The FBI later seized and verified the laptop and its contents, which included messages about Biden's foreign business dealings and explicit photos, as authentic.
The laptop was subsequently used in federal gun and tax evasion charges against Hunter Biden. However, no wrongdoing related to his business ties or his father was uncovered through this investigation. FBI Director Kash Patel has vowed to investigate the agency's actions during Biden's presidency, drawing criticism for alleged political motivation.
"Lying to Congress by senior FBI officials strikes at the heart of our system. No one is above the law," Patel stated on X. The DOJ typically aims to avoid overt investigative actions close to an election that could influence the outcome. However, in the past two weeks, the department has taken several high-profile actions in politically sensitive cases, including a search of Representative Ilhan Omar's home and the unsealing of a corruption indictment against Virginia state Senator L Louise Lucas.
